Terms of Use

These Terms of Use ("Terms") govern your use of the MakingMyself mobile app and related services (the "App"). By creating an account, using the App as a guest, or purchasing anything in the App, you agree to these Terms. If you do not agree, please do not use the App. Please also read our Privacy Policy.

1. Who we are

The App is operated by Federico Fernández, a self-employed individual (autónomo), NIF 46828066C, c/ Ciclisme 14, Rubí (Barcelona), Spain ("we", "us"). Contact and support: fredi@makingmyself.com.

2. What the App does

MakingMyself lets you write personal goals. The App generates short daily "expectation" texts and spoken audio episodes about those goals, with a morning slot and an evening slot. "Moments" are 60–90 second spoken rehearsals of an upcoming event that you describe in text. Content is generated with the help of artificial intelligence.

3. Not medical advice or a crisis service

The App is not designed to process health data, and health or medical topics are out of scope. Please do not enter health information. Goals or Moments that our automated safety system identifies as health-related are declined. Do not rely on the App as a substitute for professional help.

4. Eligibility

You must be at least 16 years old to use the App. By using it, you confirm that you meet this requirement and that you have the legal capacity to enter into these Terms.

5. Your account

You can use the App as a guest, without an email address, or register with email and password, Sign in with Apple, or Google Sign-In. Keep your credentials confidential and tell us if you suspect unauthorised access. If you forget your password, we send a 6-digit reset code to your email. You are responsible for activity under your account.

6. Acceptable use

You agree not to:

• use the App for anything unlawful, or to harm, harass or defraud others;
• enter content that is unlawful, infringes the rights of others, or concerns other people's private data without a legitimate reason;
• enter health or medical information, or use the App in place of professional care;
• attempt to bypass safety systems, usage limits, or payment mechanisms;
• reverse engineer, scrape, overload or interfere with the App or its infrastructure;
• resell or redistribute generated content commercially without our written permission.

7. Your content and AI-generated content

You keep ownership of the goals and descriptions you write. You give us a limited licence to process them solely to operate the App, including sending them to our AI provider to generate texts and speech (see the Privacy Policy). Generated texts and audio are provided for your personal, non-commercial use.

AI-generated content may be inaccurate, incomplete or inappropriate. It is not professional advice of any kind (medical, psychological, legal, financial or otherwise). You use it at your own judgement and risk.

8. Plans, subscription and credits

• Store billing. Purchases are processed by Apple (App Store) or Google (Google Play). Payment, renewal, cancellation and refunds are handled through your store account, under the store's own terms. On iOS: Settings → Apple ID → Subscriptions.
• Auto-renewal. Premium renews automatically each month at the end of each period, unless you cancel in your store account at least 24 hours before the period ends. The free trial converts into a paid subscription unless cancelled before it ends. Cancelling takes effect at the end of the current period, and you keep access until then.
• Refunds. Refund requests are handled by Apple or Google under their policies. We cannot issue refunds for purchases made through the stores. Nothing in these Terms affects any mandatory consumer rights you have by law.
• Credits. Credits have no cash value, are non-transferable and cannot be exchanged for money. If a Moment fails to generate, its credit is refunded automatically.
• Purchase state. We use RevenueCat to manage and verify your purchase state.
• Price changes. If we change prices, we will notify you in advance as required by the store and applicable law. You can cancel before the change applies.

9. Apple's standard EULA

If you download the App from the Apple App Store, Apple's standard Licensed Application End User License Agreement also applies. If these Terms and Apple's EULA conflict, Apple's EULA prevails for matters it covers.

10. Availability and changes to the App

We aim to keep the App available but do not guarantee uninterrupted or error-free operation. We may change, suspend or discontinue features, with reasonable notice where practical.

11. Termination

You can stop using the App at any time and delete your account inside the App; deletion removes your account and content (goals, expectations, audio and Moments), which completes server-side within 24 hours. Deleting the App or your account does not cancel a store subscription: cancel it in your store account. We may suspend or terminate your access if you seriously or repeatedly breach these Terms, or where required by law. Sections that by their nature should survive termination will survive.

12. Limitation of liability

The App is provided "as is" and "as available". To the maximum extent permitted by law, we are not liable for indirect or consequential loss, loss of profit, or for decisions you make based on generated content. Our total liability to you for claims related to the App is limited to the amount you paid us through the App in the 12 months before the event giving rise to the claim. Nothing in these Terms excludes or limits liability that cannot be excluded by law, including liability for death or personal injury caused by negligence, for fraud or wilful misconduct, or any mandatory rights you have as a consumer.

13. Changes to these Terms

We may update these Terms. When we make material changes, we will notify you in the App and/or by email before they take effect, and we will update the "Last updated" date above. If you continue to use the App after the changes take effect, you accept them. If you do not agree, you can stop using the App and delete your account.

14. Governing law and disputes

These Terms are governed by Spanish law. If you are a consumer, you also keep the protection of mandatory consumer law of your country of residence, and you may bring claims before the courts competent under applicable consumer rules. Otherwise, the courts of Spain have jurisdiction.
